1.1 Collection and Use

Flop the Nuts Website collects personal information for the purposes of providing products or services and for responding to your request(s) (“Business Purpose”).

Flop the Nuts may collect information provided voluntarily by you (for eg. when you fill in our forms, register for our products or services) and may from time to time request information fro you such as your full name, information regarding authorised users, email addresses, billing addresses, contact details, credit card details and all other information necessary to fulfil the Business Purpose (“Customer Personal Information”).

Customer Personal Information collected will be used solely for the Business Purpose and will be retained for as long as Flop the Nuts needs to fulfil the Business Purpose. Unless required by law, Flop the Nuts will not disclose your Customer Personal Information without your consent. All Flop the Nuts employees who may have access to your Customer Personal Information are aware of this policy and access is limited to those employees who need to know in order to fulfil the Business Purpose.

Customer Personal Information may also be used for mailings of additional Flop the Nuts products or services. You may notify Flop the Nuts if you do not wish to receive future mailings (see Unsubscribe from emails and SMS below).

1.2 Information from Minors

We do not intentionally invite Customer Personal Information from minors (under the age of 18) to this site. All Customer Personal Information known to be from minors will immediately be deleted.

1.3 Unsubscibe from Emails and SMS

At any time, should you wish to stop receiving information from Flop the Nuts, for:

(a) EMAILS - Simply click the ‘unsubscribe’ link at the bottom of the email.
(b) SMS - Respond to the SMS with the text message ‘unsubscribe’.

2. Participant Conditions

2.1 Participant Conditions

Your participation in events organized by Flop the Nuts Ptd Ltd is conditional upon you agreeing to the following terms and conditions which will ultimately make your membership a safe and enjoyable experience.

The following are the binding terms and conditions of the agreement between you and Flop the Nuts:

• Flop the Nuts is for adults only, you must be at least 18 years old. Persons under 18 years of age are ineligible.
• Participants at Flop the Nuts events must at all times behave with propriety and be considerate and respectful of the needs of staff, other members and guests.
• Flop the Nuts does not hold a liquor licence and the serving of alcohol will be under the jurisdiction of the boat operator. Flop the Nuts accepts no responsibility or liability whatsoever for any harm or injury caused to members or property as a result of alcoholic intoxication or the taking of illegal substances at a Flop the Nuts event.
• Flop the Nuts reserves the right to eject any person from any event or activity if their behaviour indicates any evidence of alcoholic intoxication or the taking of illegal substances.

2.2 Rule of Play

• The rules of play are outlined on the Flop The Nuts web site and can be accessed using this link.
• Should an issue arise not covered in the stated rules, Flop The Nuts reserves the right to determine the outcome of any dispute in the gaming rules. No correspondence will be entered into.

2.3 Poker Cruise

• A purchaser may book a quanity of tickets, however it is the sole responsibilitiy of the purchaser to ensure tickets are allocated to patrons over 18 years of age.
• Tickets that have been purchased by patrons under the age of 18 will not be refunded or returned.
• Bookings for an event will be accepted up until the day before the event takes place or when the seat allocation has been exhausted.
• Upon booking your place an electronic confirmation will be sent to your registered email address. This must be presented when boarding.
• Patrons who have purchased a ticket to a Flop The Nuts cruise and have not boarded by the predefined times set in the event schedule, will be left behind and their tickets will not be refunded or returned.

2.4 Poker Participation

• The electronic confirmation that is sent to the registered email address must be produced in order to enter a Flop The Nuts event. As registration to each event takes place each participant will be allocated a table and seat number at random.
• A record of names will be made at each poker table.
• An even allocation of chips will be supplied to each participant. The chips will have no monetary value.
• Email addresses may be recorded optionally if the participant is interested in receiving further promotional material.
• No wagering with real money will take place
• Chips are not exchangeable for cash

3. Merchandise Terms and Conditions

3.1 Returns and Exchanges

• You can return a Flop The Nuts purchase in its original condition within 14 days and get a product replacement or your purchase price refunded.
• Products that are returned because they are faulty will be assessed by Flop The Nuts before a remedy is actioned.
• Flop The Nuts cannot be held accountable for returned goods that are lost in transit. We suggest that these are packed appropriately and sent via registered post.

To return an item, please send an email to allin@flopthenuts.com.au, detailing the order number and the item name. Please let us know why you would like to return the item and what you would like us to do (e.g. replace the item, refund the item with a gift certificate etc.). We will contact you to work out the best way to return the item. We endeavour to process returns within 10-14 days.

3.2 Pricing Information

All goods and services attract the Australian Federal Government Goods and Services Tax (GST) of 10%. The prices shown for products and postage and handling include GST, and the total GST paid is shown in the Tax Invoice. All monetary values shown on this site are Australian Dollars (AUD).

4. Delivery Information

4.1 Delivery Address

We can send your purchase to anywhere in Australia and most countries in the world! We recommend sending it to an address where someone will be there during the day (e.g. your work). If this is not possible, a card will be left stating that your parcel is ready to pick up at your local post office.

4.2 Delivery Method

Within Australia we send products via standard post. The cost of postage and handling is incorporated into the price for delivery within Australia only.

4.3 Limitation of liability and Delivering Orders

Flop The Nuts will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from your use or your inability to use this website or for the cost of procurement of substitute products or services or resulting from any products or services purchased or obtained or messages received or transactions entered into through this website or resulting from unauthorised access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if Flop the Nuts has been advised of the possibility of such damages.

Where any Australian Federal or State Act of Parliament implies in these Terms and Conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in these Terms and Conditions, however, the liability of Flop The Nuts for any breach of such term, condition or warranty shall be limited, at the option of Flop The Nuts, to any one or more of the following:

(a) If the breach relates to goods: the replacement of the goods or supply of equivalent goods; the repair of such goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of the cost of having the goods repaired; and

(b) if the breach relates to services: the supplying of the services again; or the payment of the cost of having the services supplied again

5. Promo Terms & Conditions

5.1 Buy 11+ tickets get 10% off

• To be eligible, 11 tickets must be purchased under the one booking to receive the 10% discount.
• Eligibility for the 10% discount will not be available should separate blocks of bookings be made i.e. one purchase of 6 tickets and another purchase of 5 tickets will not entitle the participant to a 10% discount.
